Agreement to Terms

By accessing our website or using our travel services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, please do not use our services. These terms apply to all visitors, users, and customers of Overnight Holiday.

About Our Services

Overnight Holiday operates as a travel service coordinator and intermediary. We do not directly own or operate hotels, vehicles, houseboats, or other travel infrastructure. We arrange and coordinate services with verified third-party providers including accommodation partners, transportation operators, activity providers, and local guides.

Our services include arranging cab services, hotel bookings, houseboat reservations, wellness tourism packages, medical tourism coordination, cruise tour bookings, homestay arrangements, domestic and international tour packages, customized itineraries, and DMC collaboration services.

Service Delivery

We coordinate with third-party service providers to deliver the services described in your booking confirmation. While we carefully select our partners and monitor service quality, the actual services are provided by independent operators. We act as facilitators and are not directly responsible for the actions, omissions, or quality of services provided by these third parties.

Service timings, vehicle types, room categories, and other specifics are subject to availability and may be substituted with equivalent alternatives if the originally booked option becomes unavailable.

Customer Responsibilities

You are responsible for providing accurate personal information, valid identity documents as required, being ready at scheduled pickup times, treating service staff and property with respect, complying with local laws and regulations, having appropriate travel insurance, carrying valid identification during travel, and informing us of any special requirements or health conditions that may affect service delivery.

Limitation of Liability

As a service coordinator, our liability is limited to the service fees paid to us directly. We are not liable for any loss, injury, damage, accident, delay, or expense arising from the acts, omissions, or negligence of third-party service providers including hotels, transport operators, guides, or activity providers.

We strongly recommend that all travelers obtain comprehensive travel insurance covering trip cancellation, medical emergencies, baggage loss, and personal liability.

Medical Tourism Services

For medical tourism services, we coordinate with hospitals and healthcare facilities but do not provide medical advice or guarantee treatment outcomes. Medical decisions are made by healthcare professionals at the treating facility. You are responsible for sharing complete medical history with treating doctors. We recommend consulting with your local physician before traveling for medical treatment.

DMC Collaboration Terms

For travel agents and DMC partners, separate collaboration agreements apply. Commission rates, payment terms, and service responsibilities will be defined in individual partnership agreements. Information shared through the DMC collaboration registration is used solely for evaluating partnership opportunities and will be handled confidentially.

Intellectual Property

All content on our website including text, images, logos, graphics, and design elements are owned by Overnight Holiday or our content suppliers and are protected by copyright and intellectual property laws. You may not copy, reproduce, distribute, or use our content without written permission.

Website Use

You agree to use our website only for lawful purposes. You may not use automated systems to access our website, attempt to gain unauthorized access to our systems, transmit malware or harmful code, or use our website in any way that could damage our reputation or interfere with other users.

Dispute Resolution

Any disputes arising from these terms or our services will first be addressed through good-faith negotiation. If unresolved, disputes will be subject to arbitration in Kerala, India under the Arbitration and Conciliation Act. These terms are governed by the laws of India, and courts in Kerala shall have exclusive jurisdiction.

Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on our website with the updated date. Your continued use of our services after changes constitutes acceptance of the modified terms. We recommend reviewing these terms periodically.
